1. General provisions
This Seller Agreement for Fastyshop is an offer by the Fastyshop operator to sellers to enter into an agreement for using seller functions of the platform.
The platform operator is IE "WhiteDog". Fastyshop provides SaaS tools and e-commerce infrastructure: the seller cabinet, public shop storefronts, product and service listings, order processing, communication, support, moderation, and related technical functions.
Fastyshop is not the seller of goods or services listed by sellers unless expressly stated otherwise. The contract for sale of goods or provision of services is concluded between the buyer and the specific seller.
This Agreement supplements the Terms of Use, Privacy Policy, Consent to the collection and processing of personal data, service rules, and other Fastyshop documents.
2. Terms
- Fastyshop, the platform, or the service means fastyshop.kz, public pages, shops, the cabinet, and related Fastyshop functions.
- Operator means IE "WhiteDog", which manages Fastyshop and provides sellers with access to the service.
- Seller means a user, individual entrepreneur, LLP, individual, self-employed person, or seller representative who creates a shop, lists goods or services, and uses seller functions.
- Buyer means a user or visitor who views a shop, places an order, or interacts with a seller through Fastyshop.
- Shop means a seller's public storefront inside Fastyshop.
- Goods or services mean a seller offer listed in a shop.
- Order means a buyer's request to purchase goods or services from a specific seller.
- Tariff means a set of functions, limits, and conditions for seller access to Fastyshop capabilities.
- Verification means a check of certain seller or shop data carried out by Fastyshop in cases provided by the platform.
- Public shop data means the name, description, logo, images, goods, prices, sale terms, and other information that the seller publishes for the public storefront.
3. Acceptance of the agreement
Acceptance of the Agreement is any seller action that shows an intention to use Fastyshop seller functions: account registration, seller onboarding, creating or updating a legal profile, creating a shop, ticking consent in the interface, listing goods, using seller functions, connecting a tariff, or using an additional service.
Acceptance is full and unconditional. If the seller does not agree with the Agreement, the seller must not use Fastyshop seller functions.
A person acting on behalf of an individual entrepreneur, LLP, individual, or other seller confirms that they have authority to accept the Agreement, provide seller data, create a shop, and list goods or services.
The Agreement is accepted electronically through the interface or actions in the service. Ordinary web acceptance is not an electronic digital signature unless Fastyshop provides a separate signing scenario through EDS.
4. Who may be a seller
Sellers on Fastyshop may be individual entrepreneurs, LLPs, individuals, and self-employed persons if they have the right to sell the relevant goods or services under the laws of the Republic of Kazakhstan and the rules applicable to them.
The seller is independently responsible for the legality of its activity, tax status, registration, permits, licences, documents, the right to use a brand, images, and descriptions, and the right to sell specific goods or services.
Fastyshop may refuse access to seller functions, request additional information, or restrict a seller if there is a risk of violating the law, platform documents, buyer rights, third-party rights, or service security.
5. Seller registration and profile data
To use seller functions, the seller completes the steps provided by Fastyshop: creates an account, fills in the seller profile, legal profile, shop data, and other fields required for the service.
Fastyshop may request seller information, including IIN/BIN, full name or company name, legal form, address, phone, email, bank details, documents, licences, and permits if such information is needed for checks, orders, security, legal compliance, or platform operation.
The seller must provide accurate, current, and complete data, update it promptly when it changes, and must not use another person's data without a lawful basis.
Fastyshop does not publish private seller details in this Agreement. The public availability of specific shop and seller data is determined by the interface, Fastyshop documents, shop settings, and legal requirements.
6. Seller verification
A shop may be published before seller verification. Publication of a shop, goods, or services does not mean that Fastyshop has pre-confirmed the legality of the seller's activity, product quality, safety, licences, delivery, returns, or the seller's future actions.
Fastyshop may check the seller, shop, goods, documents, and technical signals at the seller's request, after a buyer complaint, based on internal signals, if a violation is suspected, or in other cases needed for platform security and quality.
On public shop pages, Fastyshop may show the “Verified” badge when the seller or linked legal profile has passed document review under the platform rules.
This badge means that Fastyshop requested documents from the seller and checked their validity at the time of review as one stage of seller and shop admission and control.
The badge does not mean that Fastyshop checked every product, quality, authenticity, safety, availability, price, delivery, returns, warranty obligations, reviews, correspondence, future seller actions or fulfilment of every order.
The seller is independently responsible to the buyer for goods, services, descriptions, prices, availability, delivery, returns, warranties, documents, communication and fulfilment of the seller’s obligations.
The badge does not limit buyer rights provided by law, the contract with the seller and Fastyshop documents. If the buyer has a claim about a product, delivery, payment, return or seller actions, the buyer should contact the seller and may use the available Fastyshop support channels.
Fastyshop may remove the badge, hide it, request re-review or apply measures to the seller if data changes, verification expires, complaints appear, internal risk signals arise, or there are signs of violation of law or platform documents.
7. Creating and using a shop
The seller may create a shop inside Fastyshop. The shop is the seller's public storefront and operates within the technical capabilities, tariffs, rules, and limits of the platform.
The seller is responsible for shop settings, name, description, logo, images, goods, services, prices, public data, communication with buyers, and compliance with Fastyshop requirements.
Fastyshop may set technical requirements for the shop, catalogue structure, quality of public data, images, categories, goods, descriptions, and other storefront elements.
Fastyshop may restrict certain shop functions if the seller violates platform documents, the law, buyer rights, or creates a risk for users, sellers, infrastructure, or Fastyshop's reputation.
8. Visibility in catalogue, search, and promo
Creating a shop does not mean automatic inclusion in all Fastyshop catalogues, selections, search results, recommendations, or promotional blocks.
Fastyshop may set criteria for public visibility, catalogue quality, number of published goods, verification, activity, category, data relevance, complaints, security, and other signals.
Fastyshop may hide a shop or product from the catalogue, search, selections, or promo without fully blocking the account or deleting the shop if this is needed for review, public listing quality, rule compliance, security, anti-fraud, or user protection.
If there is no separate blocking, direct access to the shop by link may remain available even when the shop is temporarily not shown in certain public surfaces.
9. Goods, services, and information about them
The seller must list only lawful goods and services and accurately state names, descriptions, images, characteristics, prices, availability, purchase terms, delivery, returns, warranties, and other information important to the buyer.
The seller must not mislead buyers, hide material terms, use another person's images, descriptions, brands, or materials without rights, or list counterfeit, dangerous, or inaccurate offers.
The seller is independently responsible for quality, safety, completeness, legality, origin, labelling, certification, warranty obligations, returns, and consumer rights compliance.
Fastyshop may technically display product cards, statuses, and order history, but this display does not mean that Fastyshop confirms the legality, quality, or safety of the offer.
The seller independently determines which requirements of the laws of the Republic of Kazakhstan on the National Catalogue of Goods apply to the seller's activity and to a particular good. If the seller manufactures or imports a good, the seller ensures its registration in the NCG before sale in the cases and manner prescribed by law. In retail or wholesale sales, the seller ensures that information about the good is available in the NCG and that the identification code is used correctly to the extent applicable to the seller's role and transaction.
The ability to save or publish a good without an identifier in the FastyShop interface does not mean that the good is exempt from legal requirements. The seller must not rely on the absence of a technical block as permission to sell a good when applicable law requires registration, information in the NCG, or use of an identification code.
If the seller specifies an NCG product identifier in FastyShop, the seller must verify that the selected card relates to the good actually offered and that the identifier and related information are accurate and current. The seller is responsible for selecting the wrong card, a mismatch with the actual good, and failing to correct known errors promptly.
Upon a lawful request or a substantiated request from FastyShop, the seller provides the information and documents needed to verify the good, identifier, and right to sell it. If the seller discovers an error, change, or loss of data currency, the seller must correct the information within the seller's control without undue delay and update or remove the link in FastyShop.
FastyShop provides a limited technical capability to find existing information from the NCG provider by an entered NTIN or GTIN and link the selected card to the seller's product card. FastyShop does not register a good in the NCG on behalf of the seller, create a product card in the NCG, assign an NTIN, GTIN, or XTIN, or provide for obtaining or replacing a temporary XTIN.
A search result, a ‘verified’ status, or previously saved information means only the technical result of interaction with the NCG provider. It is not state registration of the good by FastyShop, a legal opinion, certification, or a guarantee that the selected card corresponds to the actual good. Provider data may change, and access to the provider may be temporarily unavailable.
10. Prohibited and regulated goods
Goods, services, materials, and offers prohibited by the laws of the Republic of Kazakhstan are prohibited on Fastyshop, including narcotic substances, weapons, pornography, and other illegal, dangerous, unlawful, or fraudulent materials.
Goods and services that require a licence, permit, certification, age control, special sale conditions, special storage, delivery, or checks are prohibited without prior approval from Fastyshop or completion of an additional check if such check is provided by the platform.
Fastyshop may hide, delete, restrict, or block goods, a shop, or an account if the offer violates the law, platform documents, third-party rights, consumer rights, or creates a risk for users and the service.
11. Orders and seller obligations
A buyer places an order with a specific seller. The seller independently confirms, processes, fulfils, cancels, delivers, transfers goods, arranges returns, responds to requests, and performs obligations to the buyer.
The seller must respond to orders and requests in a timely manner, keep statuses up to date, not accept an order that cannot be fulfilled, and inform the buyer of material changes to the order.
Fastyshop may display statuses, store order history, assist with communication, and technically record actions of the parties, but it does not become the seller of goods or services.
The seller is responsible for all obligations to the buyer, including quality, safety, delivery, timing, returns, exchanges, claims, and mandatory consumer rights compliance.
12. Payments, receipts, taxes, and documents
In the current service version, Fastyshop does not accept online payments for sellers' goods and is not a party to settlements between seller and buyer unless a separate payment product is launched and described in Fastyshop documents.
Fastyshop does not issue fiscal receipts, cash register documents, or other documents on behalf of the seller. The seller is independently responsible for settlements with the buyer, fiscal receipts, cash register documents, taxes, reporting, accounting documents, and legal compliance.
If Fastyshop launches payment integrations, online payment, fiscal scenarios, or related services in the future, the terms of such functions will be updated in platform documents or issued as separate terms.
13. Tariffs and paid functions
Seller functionality is provided according to the tariff plan. By default, the seller has access to the Free tariff with basic limits for launching a shop.
The public paid Plus tariff provides extended limits and functions described on the pricing page and in the seller cabinet. Plus connection is currently performed manually: terms are agreed with the seller, and the contract, invoice, and payment confirmation are handled outside the Fastyshop interface.
The individual Personal tariff applies only after separate agreement. A request for individual terms does not guarantee connection; limits, validity period, price, payment procedure, and additional restrictions are fixed by an individual arrangement, invoice, contract, or other Fastyshop confirmation.
Paid access is valid for the agreed period. If the paid period ends, payment is overdue, terms are not renewed, or the tariff is changed to a more limited one, Fastyshop may restrict new or worsening seller actions, including publishing new goods, creating new shops, uploading media, adding categories, or configuring delivery and payment methods.
Data previously created by the seller is not automatically deleted only because the paid period ended, the tariff was downgraded, or a limit was exceeded. At the same time, Fastyshop may restrict new actions, hide invalid changes, or require the seller to bring service use into compliance with the active tariff.
Fastyshop order commissions are not provided in the current model. The buyer pays the seller for goods, services, and delivery according to the seller's terms, while Fastyshop paid tariffs relate to seller functions of the platform.
Fastyshop does not currently perform automatic recurring charges for tariffs. Reconnection, renewal, or change of a paid tariff requires manual agreement unless separate terms expressly establish another procedure.
Fastyshop may change tariffs, prices, limits, function scope, and paid access terms. Material changes are published or sent to sellers at least 14 calendar days in advance unless another period is required by law or individual terms.
Available link page features and limits depend on the applicable plan and are shown in the service interface. A plan change or the end of paid access may make certain features and publication of elements beyond current limits unavailable. Saved settings do not confer a right to display those elements publicly. Changing a plan does not give analytics consent on behalf of visitors. The procedure for changing plans and giving notice remains governed by this Offer.
14. Advertising and promotion
Fastyshop may use public shop data, goods, services, logos, images, descriptions, prices, and other public seller materials in the catalogue, selections, promo blocks, Fastyshop advertising, shop advertising, email, Telegram, social networks, landing pages, and other public Fastyshop materials.
Such use is allowed only to the extent connected with platform operation, promotion of Fastyshop, the shop, or seller goods, and must not disclose private data of the seller, buyers, or other persons beyond what is public or permitted by law.
Paid advertising, priority promotion, an advertising cabinet, or similar products may appear later and be governed by separate terms.
15. Seller content and rights to it
The seller retains rights to its content if those rights belong to the seller, but grants Fastyshop a limited right to use the content for platform operation, display of the shop, goods, and orders, support, moderation, security, quality analytics, and promotion.
The seller guarantees that it has rights to the listed names, images, logos, descriptions, brands, texts, characteristics, photos, videos, and other materials.
If seller content violates third-party rights, the law, Fastyshop documents, or moderation requirements, Fastyshop may restrict, hide, delete such content, or apply measures to the shop and account.
The seller is responsible for claims, costs, losses, and demands related to third-party rights violations by the seller's content.
The seller is responsible for the information, images and links they add and must have the rights needed to use them. A seller publishing another person’s personal contact details must have a lawful basis for making them public. Possessing a phone number or email address does not by itself give permission to publish it on a link page.
16. Buyers' personal data
The seller receives buyer data only within an order, related request, support, or another scenario provided by Fastyshop and applicable consents.
The seller must use buyer data only to process the order, arrange delivery, communicate about the order, handle returns, fulfil obligations to the buyer, and comply with legal requirements.
The seller is prohibited from using buyer data for spam, third-party advertising, resale, transfer to third parties outside the order, uploading to external databases without a lawful basis, or other purposes unrelated to the order and Fastyshop documents.
Buyer data export is not currently provided to the seller. Violation of personal data processing rules may lead to restriction of functions, blocking of the shop or account, and other measures.
17. Support, complaints, and disputes
The buyer and seller first resolve order issues with each other. Fastyshop may provide a technical request channel, receive a complaint, check the shop, goods, seller, or technical signals, and apply platform measures.
Fastyshop is not a court, arbitrator, or authority that finally resolves a civil-law dispute between buyer and seller on the merits of goods, services, money, delivery, return, or compensation.
Fastyshop may provide available information upon a lawful request from a court, police, authorised body, or other person if required by law.
Fastyshop does not assume expenses, compensation, losses, or obligations arising from a dispute between buyer and seller unless expressly required by law or a separate written agreement.
18. Moderation, restrictions, and blocking
Fastyshop may check the shop, goods, services, documents, seller actions, complaints, technical signals, and other information if needed for legal compliance, platform documents, security, anti-fraud, catalogue quality, or user protection.
Fastyshop may hide goods, restrict shop visibility, restrict functions, suspend a shop, block a shop, block an account, refuse verification, remove a badge, request additional data, or apply other reasonable measures.
For a non-critical violation, Fastyshop may give the seller time to fix it, generally 3 business days. For serious risks, illegal goods, fraud, a security threat, risk of harm to users, or an attempt to bypass Fastyshop measures, restrictions may be applied without prior notice.
Fastyshop may not disclose details of a restriction, check, or blocking if disclosure is connected with security, anti-fraud, private data, a check, a lawful request, internal signals, or risk of bypassing measures.
If FastyShop receives information about a possible error, missing mandatory NCG information, or a mismatch between the selected card and the actual good, FastyShop may request a correction or documents and apply measures provided by this Agreement and the Seller Rules. This capability does not mean that FastyShop continuously checks every good, guarantees detection of every violation, automatically blocks publication, or removes every good without an identifier.
19. Seller liability
The seller is responsible for the legality of its activity, tax status, accuracy of data, goods and services, quality and safety, prices and availability, delivery and returns, fiscal documents, licences and permits, buyers' personal data, content, third-party rights, buyer claims, fines, losses, and expenses caused by seller violations.
The seller is responsible for actions of persons who use the seller's account, shop, access, or data unless the seller proves that the violation was not the seller's fault and that the seller promptly notified Fastyshop of unauthorised access.
Mandatory consumer rights and requirements of the laws of the Republic of Kazakhstan are not limited by this Agreement.
The presence of an NTIN, GTIN, NCG card, or FastyShop technical status does not by itself confirm the legality, origin, authenticity, quality, safety, or mandatory conformity assessment of a good. The seller remains separately responsible for labelling, certificates and permits, primary, fiscal, accounting, and shipping documents, and other requirements applicable to the good and its sale.
20. Indemnification of Fastyshop
If a seller violation leads to claims, fines, losses, expenses, court costs, or demands from buyers, government bodies, right holders, contractors, or other persons against Fastyshop, the seller reimburses Fastyshop for such amounts within the limits permitted by law.
This rule applies in particular to illegal or regulated goods, inaccurate information, consumer rights violations, personal data violations, third-party rights violations, and tax, fiscal, and licensing violations by the seller.
Indemnification does not exclude other Fastyshop measures, including function restrictions, hiding goods, blocking a shop, or blocking an account.
21. Limitation of Fastyshop liability
Fastyshop provides the seller with a technical platform and functions within the available functionality, tariffs, rules, and current state of the service.
Fastyshop does not promise the seller any guaranteed sales volume, traffic, profit, business growth, orders, conversion, reviews, catalogue placement, search position, or participation in promotions.
Fastyshop is not responsible for actions of buyers, sellers, third parties, communication providers, hosting providers, cloud services, payment providers, or delivery providers beyond the limits established by law and applicable agreements.
Fastyshop is not responsible for the seller's product obligations to the buyer unless the operator expressly acts as the seller in a separate scenario. Fastyshop liability is limited to the extent permitted by the laws of the Republic of Kazakhstan.
22. Changes to the agreement
This edition, prepared for the launch of link pages, takes effect within a coordinated release after all required service components are ready. No advance preview period is provided for this one-time transition. The passage of a date, opening a document or continued use does not constitute the seller's acceptance of the new edition.
After the edition takes effect, the seller explicitly accepts the new Seller Agreement and Seller Rules through the existing common action. Seller functions, including Home in the cabinet, remain unavailable until acceptance. Continuing under the previous edition as a way to bypass this acceptance is not available.
The documents remain available to read. The seller may decline to accept the new edition, sign out and contact support@fastyshop.kz. Failure to accept does not, by itself, delete previously created pages, data, statistics or records of earlier acceptances.
The seller's acceptance of these documents does not constitute a visitor's consent to analytics. Visitors manage analytics through the existing common consent mechanism; no separate consent solely for link pages is introduced.
This transition applies only to this edition for the launch of link pages. It does not establish a permanent exception for future changes. The National Catalogue of Goods transition provisions below apply only to the historical edition that introduced the NCG.
Historical National Catalogue of Goods transition
The edition of the Agreement that introduces terms concerning the National Catalogue of Goods is a material change and requires the seller's explicit renewed acceptance in the FastyShop interface. FastyShop notifies sellers by publicly publishing the new edition of the Agreement at least 14 calendar days before the earliest date on which it may be activated. The publication date and earliest activation date are stated in the edition itself.
Until the new edition is separately and explicitly activated, the previous edition remains mandatory. FastyShop may activate the new edition only through a separate operation and no earlier than its stated earliest activation date. After that operation, FastyShop may restrict seller functions until the seller explicitly accepts the new Agreement and new Seller Rules. Publication of the new edition, continued use of the service, and consent previously given to another edition do not by themselves replace this acceptance. Advance acceptance before the edition is separately activated is neither required nor used to provide seller functions.
The seller retains access to the document texts, the ability to sign out of the account, and the ability to stop using seller functions.
23. Term and termination of the agreement
The agreement between the seller and Fastyshop is effective from the moment of acceptance of the Agreement until the seller stops using seller functions or access is terminated on grounds provided by Fastyshop documents and the law.
The seller may stop using seller functions, delete or deactivate the shop if such function is available, or contact support at support@fastyshop.kz.
Termination of the agreement does not cancel the seller's obligations for already placed orders, returns, claims, taxes, fiscal documents, personal data, disputes, indemnification, and legal requirements.
Fastyshop may terminate or restrict seller access if the seller violates the Agreement, Terms of Use, service rules, the law, third-party rights, security requirements, or creates a risk for users and the platform.
24. Applicable law and request procedure
This Agreement is governed by the law of the Republic of Kazakhstan.
Seller requests about the Agreement, seller functions, shop, checks, restrictions, and support should be sent to support@fastyshop.kz.
Fastyshop responds to requests as they are processed during support hours unless the law, a separate document, or the nature of the request requires another procedure.
The parties try to resolve disputes under this Agreement through negotiations. If no agreement is reached, the dispute is resolved under the procedure provided by the laws of the Republic of Kazakhstan.
The Russian version of this Agreement is the primary version. Kazakh and English versions are reference translations for user convenience; if there is any discrepancy, the Russian text applies.
